Earlier this month, the Illinois Supreme Court Rule Committee announced it will hold a public hearing this March to present eight different proposals that will make significant changes to our state’s Supreme Court Rules.
Proposals offer to create and amend rules surrounding consumer debt collection, foreclosure, and eviction cases. The public hearing will also address collaborative law, discovery, post-judgement motion, restorative justice practices, and more.
On March 26th, the Illinois Rules Committee will present the following proposals at the scheduled hearing:
- Proposal 15-03 (P.R. 0228): The Rules Committee seeks comments on a proposal to create Supreme Court Rules to standardize pleading requirements in certain types of consumer debt collection cases.
- Proposal 16-05 (P.R. 0236): The Rules Committee seeks comments on a proposal to amend Supreme Rule 113(i) to clarify that special representatives appointed to represent deceased mortgagors in foreclosure actions are entitled to costs and attorney fees for their services.
- Proposal 17-01 (P.R. 0240): The Rules Committee seeks comments on a proposal to amend Supreme Court Rule 214(a) to clarify the triggering event for the 28-day period.

- Proposal 17-05 (P.R. 0244): The Rules Committee seeks comments on a proposal to amend Supreme Rule 274 to clarify that the post-judgment motion is not due until the judgment order is both final and appealable.
- Proposal 17-07 (P.R. 0246): The Rules Committee seeks comments on a proposal to create a Supreme Court Rule establishing a privilege for statements made during the course of a restorative justice practice.
- Proposal 17-12 (P.R. 0251): The Rules Committee seeks comments on a proposal to amend Supreme Rules 201-212 to eliminate the discovery/evidence deposition dichotomy to adopt a single deposition.
- Proposal 18-03 (P.R. 0254): The Rules Committee seeks comments on a proposal to create a rule requiring that a copy of the predicate written demand, termination notice, proof of service of the demand or notice and, where applicable, relevant portions of the lease be attached to the eviction complaint at the time of filing.
The public hearing, set for March 26th, will begin at 10:30am in Room C-500 of the Michael A. Bilandic Building in Chicago.
